Copyright Policy - Explanation
📸 Copyright Policy Explained Plainly
We’ve noticed that some clients are curious about what happens to photos and videos after a property is sold or rented. Good question, and here’s the straight answer.
Who Owns the Photos?
Under U.S. copyright law, the person who takes the photograph is the copyright owner of that image. That’s us. What you’re purchasing is a license to use the photos and videos for the specific purpose of marketing a home, usually during the term of your listing agreement.
Unless we’ve signed a written agreement transferring ownership, the copyright stays with us. That means:
- You cannot sell or give the images to another agent who takes over the listing
- If someone else wants to use our work, kindly point them our way. We’re happy to:
- Re-shoot the property
- Or license existing images again
We all want the home buying and selling process to go smoothly, including the photos that help make it happen. If we ever need to use a stock image or two due to bad weather, privacy concerns, or community rules, we’ll always aim to make each listing feel fresh and unique.
Want Full Control?
If you need exclusive rights to the images, including use beyond the original listing, let us know up front. We can arrange full copyright transfer for an additional fee and document it properly.
Official Terms for Photography Agreement and License
📷 Rights of Client
- You are granted the right to use the delivered photos and videos to market and sell the property during your listing agreement or to promote a vacation rental.
- These rights extend to you and your multiple listing service solely for that purpose.
- You agree not to transfer, assign, or sublicense your rights to others without written permission.
Payment and Usage
- If you have paid in full, you may use the products for the designated purpose.
- Our fee is due upon delivery of the products.
- If payment is not made within 30 days, your usage rights are automatically revoked.
Review and Revisions
- Please review the delivered products promptly upon receipt.
- Requests for additional services after 7 days will incur additional fees.
- If the products are not acceptable, notify us in writing within 7 days. We will either fix or replace them as necessary.
Copyright and Ownership
- All copyrights remain with us. All photographs are the exclusive property of Kramerica Enterprises Inc.
- This agreement does not transfer copyright ownership to you.
- You are permitted to post the images on MLS platforms and social media to help sell or rent the property.
- You are not permitted to allow third parties to use the images in a way that competes with our services unless we grant written permission.
Licensing Requests
- If anyone else requests rights to the products, please refer them to us.
- We may license the products to others for an additional fee at our discretion.
